The Core Issue in Miller: The Relevance of Section 1 of the 1972 Act

Mikolaj Barcentiwicz has written a report for the Judicial Power Project which examines section 1 of the European Communities ACt 1972. The report argues that, when interpreted correctly, section 1 of the Act provides strong support for the Government's argument in the recent Miller case that Article 50 can be triggered by prerogative powers and does not require parliamentary authorisation.
